These Terms of Service ("Agreement") constitute a legally binding agreement between you ("Client," "you," or "your") and Deluxe Art Stone, a division of Deluxe Art Group ("Company," "we," "our," or "us"), governing the provision of countertop fabrication, installation, and related services.

By engaging our services, you agree to be bound by these Terms. Please read them carefully.


1. Services Overview

1.1 Scope of Services

Deluxe Art Stone provides comprehensive countertop fabrication and installation services including, but not limited to:

Countertop Services:

  • Countertop fabrication from natural and engineered stone
  • Professional measurement and templating
  • Precision cutting and edge profiling
  • Professional installation
  • Sink cutouts and undermount sink installation
  • Backsplash fabrication and installation

Materials We Offer:

  • Granite countertops
  • Quartz (engineered stone) countertops
  • Quartzite countertops
  • Marble countertops
  • Dekton (ultra-compact surface) countertops
  • Other specialty stone products

Applications:

  • Kitchen countertops
  • Bathroom vanities
  • Bar tops and islands
  • Outdoor kitchen surfaces
  • Fireplace surrounds
  • Custom stone features

1.2 Service Locations

We primarily serve:

  • Myrtle Beach and Grand Strand area
  • Horry County, South Carolina
  • Georgetown County, South Carolina
  • Adjacent coastal regions (by agreement)

1.3 Customized Projects

Each project is unique. Specific services, timelines, and deliverables will be defined in:

  • Individual proposals and quotes
  • Signed service agreements
  • Change orders and amendments
  • Written communications and agreements

2. Engagement Process

2.1 Initial Consultation

Our engagement process begins with:

  • Free Consultation: Visit our showroom or schedule in-home consultation
  • Material Selection: Browse our 300+ slabs to choose your stone
  • Measurement Overview: Preliminary discussion of project scope
  • Quote Preparation: Detailed estimate based on your project needs

2.2 Proposal and Quote

Following consultation, we provide:

  • Detailed Proposal: Scope of work, materials, and specifications
  • Itemized Quote: Breakdown of costs including material, fabrication, and installation
  • Edge Profile Selection: Options for countertop edge treatments
  • Timeline Estimate: Projected template date and installation date

2.3 Contract Execution

To proceed with your project:

  • Written Agreement Required: All projects require a signed service agreement
  • Deposit Payment: 50% deposit to order materials and schedule templating
  • Material Selection: Final approval of selected slab(s)
  • Cabinet Readiness: Cabinets must be installed and level before templating

2.4 Project Workflow

Our standard process:

  1. Material Selection: You select your slab(s) at our warehouse
  2. Templating: We measure your countertops after cabinets are installed (typically 30-45 minutes)
  3. Fabrication: We cut and finish your countertops at our facility (3-5 business days)
  4. Installation: Professional installation at your location (typically 1 day)
  5. Final Walkthrough: Inspection and client acceptance

3. Payment Terms

3.1 Payment Structure

Our standard payment structure:

Deposit:

  • 50% of total project cost upon agreement signing
  • Secures your material and project scheduling
  • Non-refundable once material is cut

Final Payment:

  • 50% due upon completion of installation
  • Payment required before crew leaves the job site
  • All approved change orders included in final payment

3.2 Payment Methods

We accept:

  • Check or bank transfer (preferred)
  • Credit/debit cards (may include 3% processing fee)
  • Cash

3.3 Late Payments

  • Final payment due at completion of installation
  • Unpaid balances may incur 1.5% monthly service charge
  • We reserve the right to file a mechanic's lien for non-payment

4. Project Timeline

4.1 Estimated Timelines

  • Template to Installation: Typically 7-10 business days
  • Fabrication Time: 3-5 business days after templating
  • Installation Time: Most projects completed in 1 day

Timelines are estimates and may vary based on project complexity and material availability.

4.2 Delays Beyond Our Control

We are not liable for delays caused by:

  • Material availability or supplier delays
  • Cabinet or plumbing not ready for template
  • Client-requested changes after deposit
  • Weather affecting installation access
  • Acts of God, natural disasters, or pandemics

4.3 Client-Caused Delays

If cabinets are not ready for scheduled templating:

  • We will reschedule at next available time
  • Significant delays may affect material reservation
  • Rush scheduling may incur additional fees

5. Change Orders

5.1 Scope Changes

Any changes after templating require:

  • Written Change Order: Detailed description of changes
  • Cost Adjustment: Additional costs for modifications
  • Timeline Impact: Revised completion date if applicable
  • Client Approval: Signature required before work proceeds

5.2 Common Change Order Items

  • Edge profile upgrades
  • Additional cutouts (soap dispensers, etc.)
  • Backsplash additions
  • Cooktop or sink changes after template
  • Material changes or additions

6. Materials and Workmanship

6.1 Material Quality

We use:

  • Premium natural and engineered stone from reputable suppliers
  • Materials from brands like MSI, Cosentino (Silestone, Dekton), and others
  • Stone meeting industry quality standards

6.2 Natural Stone Characteristics

Natural stone (granite, marble, quartzite) features:

  • Unique Variation: No two slabs are identical
  • Natural Characteristics: Pitting, fissures, and veining are normal
  • Color Variation: Colors may vary from samples or photos
  • Sealing Required: Natural stone requires periodic sealing

By selecting natural stone, you accept these natural characteristics.

6.3 Seams

  • Seams may be necessary for larger countertops or certain layouts
  • Seam placement is determined by template and fabrication requirements
  • We minimize seams and place them strategically
  • Seams are visible but finished professionally

6.4 Workmanship Standards

We commit to:

  • Professional fabrication using CNC machinery
  • Precise cuts and quality edge profiling
  • Experienced installation by trained professionals
  • Clean jobsite upon completion

6.5 Remnants

Leftover material (remnants) from your project:

  • Remain property of Deluxe Art Stone
  • Cannot be credited or returned
  • May be available for purchase for additional pieces

7. Installation Requirements

7.1 Cabinet Readiness

Before template, cabinets must be:

  • Fully installed and secured
  • Level and properly supported
  • Accessible for measurement

7.2 Plumbing

  • Plumbing should be disconnected before installation
  • We do not perform plumbing work
  • Recommend having plumber reconnect after installation
  • We install undermount sinks (sink must be on-site)

7.3 Access Requirements

Client agrees to provide:

  • Clear access to work areas
  • Safe path for carrying countertop sections
  • Parking near entry point
  • Functioning water and electricity

7.4 Site Cleanup

We will:

  • Clean countertop surfaces
  • Remove installation debris
  • Vacuum work area
  • Apply sealer to natural stone (included)

8. Warranties

8.1 Our Workmanship Warranty

We warrant that:

  • Installation meets professional standards
  • Fabrication is free from defects
  • Seams are professionally finished

Workmanship Warranty Period: 1 year from installation

8.2 Manufacturer Warranties

  • Quartz brands typically offer 10-25 year warranties
  • Silestone: 25-year warranty
  • Dekton: 25-year warranty
  • Natural stone: Fabrication warranty only (no material warranty)

8.3 Warranty Exclusions

Warranties do not cover:

  • Chips, scratches, or damage after installation
  • Damage from heat, impact, or improper use
  • Staining from neglected spills
  • Damage from harsh chemicals or cleaners
  • Normal wear and characteristics
  • Damage from lack of proper sealing (natural stone)
  • Modifications or repairs by others
  • Acts of God or natural disasters

8.4 Warranty Claims

To make a warranty claim:

  • Contact us within warranty period
  • Describe the issue with photos
  • Allow us reasonable access to inspect
  • We will respond within 10 business days

9. Limitations of Liability

9.1 Our Liability

We are responsible for:

  • Damage directly caused by our negligence during installation
  • Repairing or replacing defective workmanship
  • Losses covered by our insurance policies

9.2 Limitation of Damages

We are NOT liable for:

  • Indirect, consequential, or punitive damages
  • Damage to cabinets from pre-existing conditions
  • Plumbing or electrical issues
  • Damage from events beyond our reasonable control
  • Issues caused by client actions or third parties

9.3 Maximum Liability

Our total liability shall not exceed the contract price for the affected portion of work.


10. Cancellation and Refunds

10.1 Cancellation Before Template

If you cancel before templating:

  • Deposit may be refunded minus administrative fee
  • Special-order materials are non-refundable
  • 30% restocking fee may apply for reserved slabs

10.2 Cancellation After Template

If you cancel after templating:

  • No refund of deposit
  • Material costs are non-refundable
  • Fabrication costs are non-refundable

10.3 Cancellation After Fabrication

Once material is cut:

  • No refunds available
  • Countertops are custom-made to your specifications
  • Material cannot be returned or repurposed

11. Dispute Resolution

11.1 Good Faith Negotiation

Before pursuing legal action, parties agree to:

  • Attempt resolution through direct communication
  • Meet to discuss disputes within 30 days
  • Negotiate in good faith

11.2 Governing Law

This Agreement is governed by South Carolina law. Disputes shall be resolved in Horry County, SC courts.

11.3 Limitation Period

Claims must be brought within 1 year of installation or discovery of the issue.


12. General Provisions

12.1 Entire Agreement

This Agreement, together with your signed service agreement, constitutes the entire agreement.

12.2 Amendments

Modifications must be in writing and signed by both parties.

12.3 Severability

If any provision is found invalid, the remainder of the Agreement remains in effect.

12.4 Assignment

You may not assign this Agreement without our written consent.
